There are many traps for an inexperienced ERISA practitioner to know before deciding whether to handle an ERISA claim. Among these traps are the need to submit a timely and informative appeal, the need to identify and calculate the statute of limitations, and the importance of a rigorous pre-suit review of the claim. Each of these areas must be carefully reviewed in an ERISA claim or the client may suffer the consequences. This seminar will cover how to ID an ERISA claim, the procedural effects of an ERISA claim v. state law, and the pitfalls to avoid – exhausting remedies, calculating the statute of limitations, and understanding the right standard of review in court.
