This talk will provide you with the basics of what you need to know to prosecute and defend attorney’s fees claims in Texas, particularly under Chapter 38 of the Texas Civil Practice & Remedies Code. Areas will include:
- Traditional vs Lodestar Method (and avoiding the trap of inadvertently electing the latter)
- When to use contemporaneous billing records (i.e. when you do not wish to commit malpractice)
- Whether you need to segregate fees
- How to controvert the fee application
- And so much more
