This seminar will cover the business case for Mediation/Arbitration. It will go into when and how to use mediation, saving time and getting better results in mediation, when and how to use arbitration, and reducing the cost of an arbitration. It will also address arbitration clauses and independent arbitration agreements and expediting the arbitration process. It will cover insuring a party’s willing consent to a mediated agreement and avoiding “buyer’s remorse,” full disclosure and understanding of tax and attorney’s fees issues in a mediated agreement, a discussion of the consequences and possible benefits of not having a jury determination, and understanding and communicating that arbitration is different from litigation.
