Immigration is perennially in the news. The topic is often grist for heated debates. But what are the rules governing immigration? Who gets to come, and where does one join the “line”? This presentation explores United States immigration law, including the current structure, challenges, and outlook for the future.

Immigration is governed by a complex yet outdated statutory structure that delegates broad discretionary authority to the Executive branch. Frequently, changing agency policy can significantly impact rights and the availability of benefits under the law. Increasingly, state legislatures are enacting immigration-related laws that impact a broad range of issues including employment, land ownership, acquisition of an existing business, enforcement of criminal laws, driver’s licenses, and family law. Consideration of a party’s immigration status is essential even for attorneys who do not practice immigration law.

There should be no active campaigning, no literature distributed, no buttons worn, essentially nothing to indicate that a judge is in a contested race, and certainly nothing urging a favorable vote. Judges and judicial candidates may serve on HBA committee(s) and appear in HBA programs.
