This CLE will cover the recent FTC rule banning certain non-compete agreements and its implications for Texas litigation. Specifically, the following will be discussed: (1) the scope and exceptions to the non-compete ban, (2) the authority of the FTC to issue the rule, (3) current litigation challenging the rule, (4) potential impacts and issues for on-going and future litigation in Texas courts, including on appeals
