Succession Planning and Cessation of Practice
The arc of a lawyer’s practice eventually comes to an end. Ideally, the lawyer is ready, and the mode of transition protects clients, staff, and the lawyer’s family.
The Texas Supreme Court regulates Cessation of Practice to foster order. This webinar addresses legal and ethical issues in sale of a practice, custodianship of a practice, closing a practice, and consequences of planned and unplanned cessations.
This webinar will cover Texas disciplinary rules implicated in the sale or transfer of a practice, including topics on client consent, confidentiality, and management of client files and client funds, as well as a look at ABA Model Rule 1.17 on Sale of Law Practice. The course will also cover Part 13 of the Texas Rules of Disciplinary Procedure pertaining to cessation of practice, custodianship of a practice, and ethical guidance on screening client files for attorney’s-eyes-only documents and final disposition of closed files.
1.5 hours of MCLE credit, including 1.5 hours of ethics.
