TROs and Injunctions in Departing Employee Litigation (Including Ethics!)

In Lawsuits against former employees for breach of non-compete, misappropriation of trade secrets, and other claims, the TRO hearing or temporary injunction hearing is often the key event. This program will cover the key legal and practical issues that come up in these hearings, including ethical issues such as candor to the tribunal. Ethical issues often arise when a company seeks a TRO or temporary injunction against a former employee, including communications with parties not represented by counsel, potential conflicts of interest when jointly representing defendants, and the duty of candor to the tribunal.
