February 4th - Best Practices for Appellate Brief Writing: Perspectives from the Bench and Bar

This seminar will discuss how to draft briefs that are reader friendly for the computer and paper reader. It will cover the use of bookmarks, hyperlinks, and appendix contents as well as tips for persuasive writing. It will delve into how to consult the appellate court’s internal operating procedures and local rules. There will be highlights from the Standards for Appellate Conduct from the Texas Supreme Court and the Disciplinary Rules. There will be a discussion of candid use of binding versus persuasive authorities and effective use of citations to the official record.
1 hour of MCLE credit, including .25 hours ethics.
February 11th - Attorney-Client Fee Disputes and Ethical Use of Arbitration Clauses in Fee Contracts

Fee Dispute Committee Co-Chairs Rafael Boza, Charles Jeremiah and Alicia Castro will discuss how to utilize the HBA Fee Dispute process, the ethical use of arbitration clauses in attorneys’ engagement letters, the pros and cons of such clauses, and how to effectively include such clauses in engagement agreements. The speech will cover the topics of fee disputes and the use of arbitration clauses in attorney-client engagement agreements, both of which relate to ethics and the Texas Disciplinary Rules of Professional Conduct.
1 hour of MCLE credit, including 1 hour ethics.
